Terms of Service
Terms of Service
The agreement between a park and Bugpi. Last revised 14 October 2026.
1. Who this is between
These terms form the agreement between the business named on the order ("the park", "you") and [legal entity], [tax number], [address] ("Bugpi", "we"). Together with the order that states your plan, parks and fees, they govern your use of the Bugpi service: online bookings, reception and check-in, agenda, families, vouchers and promo codes, email, sales, settings and the connections to your invoicing and payment providers.
2. Definitions
"Service" is the Bugpi software, its booking pages, its panel and any app or add-on we provide. "Users" are the people you give accounts to. "Guests" are the parents, children, schools and other visitors who book or visit your park. "Guest data" is the personal data of guests recorded in the Service. "Park content" is your logos, texts, prices, images and settings. "Order" is the plan and fees agreed at signup, including any custom work scoped separately.
3. The service and what we build for you
We provide the Service for each park named on the order, in a professional manner and with reasonable care. We set it up with you: activities, sessions, prices, texts and connections. Setup that is part of your plan is included; custom work for your park is scoped and quoted before we start, becomes part of the Service, and stays available to you for as long as you subscribe.
We keep improving the Service. New features may be included in your plan or offered as a separate option; we never remove a feature you rely on without 30 days' notice and an alternative.
4. Your account and your users
You decide who on your team gets an account and which role they have, and you are responsible for what they do in the Service and for keeping credentials safe. Tell us at once if you suspect an account has been misused. You must have the authority to sign for each park on the order.
5. Branding
The booking pages and emails carry your brand, on your domain. Guests see your park, not Bugpi. We will only name your park as a customer, or use its logo, with your written agreement.
6. Park content and guest data
Park content stays yours. You give us a licence to use it only to provide the Service. You are responsible for having the rights to what you upload.
Guest data stays under your control: you are the controller and we are the processor, as described in the Privacy Policy and in the data processing terms that form part of this agreement. We use guest data only to run the Service for you, never for our own marketing, and never sell it. We may produce anonymous, aggregated statistics that cannot identify a park or a person.
7. Your legal responsibilities as a park
Bugpi is software, not legal advice. Running a park involves rules that vary by country: consumer law, data protection, invoicing, vouchers, child safety. You are responsible for complying with them, and we recommend a local lawyer for the texts below.
Your own terms and privacy policy. The booking pages must be covered by your park's terms and privacy policy, shown to guests, which allow us to process guest data on your behalf. We provide a template as a starting point; it is not legal advice.
Waivers. The Service collects signed responsibility terms. The wording, its validity and whether it protects your park are your responsibility. Have it checked in your country.
Vouchers and hour packs. The money for vouchers and packs is paid to you, not to us. You hold the value and are responsible for the rules that apply to it, including refunds and expiry. Vouchers sold through Bugpi may only be redeemed at the parks on your order.
Promo codes, prices and taxes. You set them and you are responsible for them.
8. Payments and invoicing
Bugpi does not collect money from guests. Payments go through the payment provider you contract (cards, MB WAY, Stripe, PayPal or another on our list), under that provider's terms and fees. Invoices and receipts are issued by your certified invoicing software, under your account with that provider. We connect the Service to both; we are not a party to those contracts and are not responsible for their performance, their fees or their legal compliance.
We may stop supporting a provider with 30 days' notice; when that happens we help you move to another one on the list.
9. Acceptable use
You will not, and will not let anyone, copy, resell, reverse-engineer or build a competing product from the Service; use it to store unlawful content or malicious code; interfere with its operation; send messages that break anti-spam or privacy law; or put abnormal load on it. We may limit or suspend access to deal with a breach, and will tell you why.
10. Fees
Fees are a flat monthly amount per park as stated on the order, with no commission on bookings, invoiced monthly in advance and payable within 15 days. Custom work is invoiced as agreed in its quote. We may change plan fees with 30 days' written notice; the new fee applies from your next monthly period. Unpaid invoices may lead to suspension after a reminder.
11. Term, leaving, and your data when you leave
The agreement runs month to month. You can end it at the end of any month by telling us in writing; we can end it with 30 days' notice, or at once for a serious breach not fixed within 15 days of our notice, or if you become insolvent.
When it ends we give you an export of your bookings, families, vouchers and sales in a common file format, keep your data for 30 days in case you come back, then delete it except what the law requires us to keep.
12. Availability, support and security
We aim to keep the Service available at all times and answer support requests within one working day on all plans, with priority on Group. Planned maintenance is announced in advance. We protect the Service with encryption in transit and at rest, backups and access controls, and notify you without undue delay of any security incident affecting your data. No online service is immune from risk; you keep reasonable safeguards on your side, including on the devices at reception.
13. Confidentiality
Each side keeps the other's non-public business information confidential and uses it only for this agreement. Guest data is covered by section 6, not by this clause.
14. Warranties and liability
We warrant that the Service will work materially as described in the product pages and the order. If it does not, we fix it; that is your remedy. Beyond that, the Service is provided as is, and we do not warrant that it will be error-free or uninterrupted, or that any third-party provider will perform.
Neither side is liable to the other for indirect or consequential loss, including lost profit or lost bookings. Our total liability under this agreement is capped at the fees you paid us in the 12 months before the claim. Nothing limits liability for fraud, wilful misconduct, or anything that cannot be limited by law.
15. Intellectual property and feedback
The Service, its code, design and trademarks are ours. Features we build for your park are ours too, but you keep the right to use them as part of your subscription. Suggestions you give us may be used to improve the Service without obligation.
16. General
This agreement is governed by Portuguese law; disputes go to the courts of Lisbon, unless mandatory law gives you another forum. If a clause is invalid the rest stands. Notices are sent by email to the addresses on the order. We may update these terms with 30 days' notice by email; continuing to use the Service after that date means you accept the new terms.
